TERMS AND CONDITIONS FOR EFOIL AND ACCESSORIES

1.1. By purchasing an eFoil or its accessories through Action Yachts, you enter into a contract with Action Yachts. These Terms and Conditions ("Terms") define the terms of this contract.

1.2. Further information about our company is available in the About Us section on our website.

1.3. By placing an order (e.g., clicking the purchase button), you accept these Terms, including the Complaint Policy, Privacy Policy, Shipping Terms, and other referenced documents.

1.4. Summaries within sections serve only as guidance and are not legally binding. Numbered paragraphs are legally binding.

 

2. Shopping at Action Yachts

2.1. You can shop online at www.jetblade.eu, via email, phone, or at our showroom.

2.2. Your order is created when you submit it and becomes binding once we confirm it via email.

2.3. Orders are accepted 24/7 online. We are not liable for outages caused by force majeure.

2.4. In-store and email/phone orders are concluded upon confirmation or payment.

2.5. Action Yachts retains ownership of goods until full payment is received.

 

3. Special Items and High-Value Orders

3.1. Pre-orders, orders exceeding €10,000, and motorized items (e.g., eFoils) may have specific requirements.

3.2. For high-value orders, full payment is required prior to dispatch. Verification may be required.

3.3. Purchases of eFoils and accessories are restricted to persons aged 18+.

3.4. Upon delivery, we may request identification to confirm the recipient's age.

 

4. Delivery and Acceptance

4.1. Delivery methods, timelines, and terms are listed on our website.

4.2. Upon delivery, inspect the goods. Report damage with supporting photos and documentation.

4.3. If goods are not accepted or collected, the contract may be canceled.

 

5. Warranty and Complaints

5.1. The warranty period is 24 months unless specified differently below. Full complaint handling details are found in the Complaint Policy.

5.2. Notify us if ownership of goods changes. We address claims with the original purchaser unless otherwise agreed.

5.3. eFoil Warranty Period:

  • Board: 1 year

  • Power Assembly: 2 years

  • Wing: 12 months

  • Smart Battery: 24 months or fewer than 300 charging cycles

  • Remote Controller: 2 years

  • Charger: 2 years

5.4. After-Sales Service Plan: If you encounter an issue that cannot be resolved using the user manual, you may contact Action Yachts d.o.o. Please describe the issue in detail. Our technical support team will attempt to resolve the issue remotely via email, phone, or other methods. If the issue cannot be resolved, you may return the product to Action Yachts, who will provide after-sales service based on the warranty conditions. For serious damage, please contact us in advance for repair arrangements.

5.5. Warranty Conditions: Products are eligible for warranty if:

  • You have valid proof of purchase (warranty period is 180 days from purchase); without proof, 240 days from shipment.

  • The issue is confirmed by our technical team as a manufacturing defect.

  • The product’s serial number is intact and legible. Note: Repaired items that are out of warranty are covered by an extended 60-day warranty starting from the date of return.

5.6. Warranty Does Not Cover:

  • Products or parts outside of the warranty period.

  • Damage during transport, loading, or unloading.

  • Unauthorized repairs or modifications, including circuit or battery changes.

  • Accidental or user-induced damage (e.g., cracks, deformation, broken cables).

  • Improper installation, usage, or storage contrary to the manual.

  • Use of non-original accessories.

  • Use beyond normal conditions (e.g., overloading, misuse, extreme sports).

  • Altered, missing, or unreadable serial numbers or labels.

  • Normal wear and tear or cosmetic damage (e.g., worn board shell).

  • Damage caused by force majeure (earthquakes, floods, fires, etc.). 

6. Withdrawal from the Contract

6.1. Consumers may withdraw from the contract within 14 days of receiving goods.

6.2. Goods must be returned unused, undamaged, and clean, ideally in original packaging. Return shipping is at your expense.

6.3. If the goods are opened and used beyond necessary inspection (e.g., eFoil ridden, battery charged), the refund may be reduced depending on wear and resale value. This complies with Article 86(7) of the Croatian Consumer Protection Act.

6.4. You cannot withdraw if the product was customized (e.g., color, personalization) or if services were already provided upon your request within the 14-day period (e.g., eFoil setup).

6.5. Goods of a consumable or technical nature, such as the eFoil battery, can only be returned if their original safety packaging is unopened and undamaged. Opened batteries are non-returnable for safety and performance reasons.

6.6. If you return damaged, scratched, or clearly used eFoils or accessories (e.g., scratched foil board, wet remote, used fins), the refund will be reduced based on wear and resale value.

6.7. Refunds will be processed within 14 days of your withdrawal notice, using the same payment method, and only after the goods have been received.

6.8. For cash payments, Action Yachts may require a valid ID to issue the refund.

6.9. If gifts were provided with your order, you must return them along with the goods.

6.10. If a discounted accessory was purchased along with the eFoil, the discount is conditional. If the main item (eFoil) is returned, the accessory must also be returned, or the discount value will be deducted from the refund.

6.11. Business customers do not have a legal right to withdraw from the contract. However, Action Yachts may allow withdrawal under the same conditions as for consumers on a goodwill basis.

6.12. Action Yachts reserves the right to withdraw from a contract due to pricing errors, regulatory restrictions, or supplier unavailability.

 

7. Payment and Prices

7.1. Prices are in EUR and include VAT. Shipping is calculated at checkout.

7.2. Until paid in full, goods remain the property of Action Yachts.

7.3. Refunds will be issued in the original payment currency and method, where possible.

7.4. If cryptocurrency is used for payment (e.g., Bitcoin), refunds will be issued in EUR, and exchange rate differences will not be compensated.

 

8. Final Provisions

8.1. Croatian law applies exclusively. Disputes shall be resolved by courts in Croatia.

8.2. Contracts are concluded in Croatian. In case of discrepancies in translations, the Croatian version prevails.

8.3. These Terms are effective as of 01.02.2025 and replace previous versions.

8.4. These Terms are available at our headquarters and electronically on www.jetblade.eu.
